भारतीय दंड संहिता 1860 की धारा 354 के अनुसार,
स्त्री की लज्जा भंग करने के आशय से उस पर हमला या आपराधिक बल का प्रयोग – जो कोई किसी स्त्री की लज्जा भंग करने के आशय से या यह सम्भाव्य जानते हुए कि तदद्वारा वह उसकी लज्जा भंग करेगा, उस स्त्री पर हमला करेगा या आपराधिक बल का प्रयोग करेगा, [वह दोनों में से, किसी भांति के कारावास से, जिसकी अवधि एक वर्ष से कम की नहीं होगी किंतु जो पांच वर्ष तक की हो सकेगी, दंडित किया जाएगा और जुर्माने से भी दंडनीय होगा।]
राज्य संशोधन
मध्य प्रदेश — धारा 354 के बाद, निम्न धारा अन्त:स्थापित की जायेगी, अर्थात् —
‘354 क. स्त्री का कपड़ा उतरवाने के आशय से उस पर हमला या आपराधिक बल का प्रयोग – जो कोई किसी स्त्री की लज्जा भंग करने के आशय से या यह सम्भाव्य जानते हुए, कि ऐसे हमला द्वारा, वह तदद्वारा कपड़ा उतरवाकर स्त्री की लज्जा भंग करता है या लज्जा भंग करवाता है या उसे किसी सार्वजनिक स्थान पर निर्वस्त्र होने के लिए विवश करता है, स्त्री पर हमला करेगा या आपराधिक बल का प्रयोग करेगा या हमला करने के लिए दुष्प्रेरित करेगा या षड्यन्त्र करेगा, या किसी स्त्री पर ऐसे आपराधिक बल का प्रयोग करेगा, वह दोनों में से किसी भांति के कारावास से, जो एक वर्ष से कम नहीं होगा किंतु दस वर्ष तक का हो सकेगा, दंडित किया जाएगा और जुर्माने के लिए भी दायी होगा।’ [2004 के म. प्र. According to Section 354 of the Indian Penal Code 1860,
Assault or criminal force to woman with intent to outrage her modesty — Whoever assaults or uses criminal force to any woman, intending to outrage or knowing it to be likely that he will thereby outrage her modesty, [shall be punished with imprisonment of either description for a term which shall not be less than one year but which may extend to five years, and shall also be liable to fine]
STATE AMENDMENT
Madhya Pradesh — After Section 354 the following section shall be inserted, namely.
‘354-A. Assault or use of criminal force to woman with intent to disrobe her — Whoever assaults or uses criminal force to any woman or abets or conspires to assault or uses such criminal force to any woman intending to outrage or knowing it to be likely that by such assault, he will thereby outrage or causes to be outraged the modesty of the woman by disrobing or compel her to be naked on any public place, shall be punished ‘with imprisonment of either description for a term which shall not be less than one year but which may extend to ten years and shall also be liable to fine.” [(Amendment) Act, 2004 (14 of 2004), Sec. 3]
