भारतीय दंड संहिता 1860 की धारा 307 के अनुसार,
हत्या करने का प्रयत्न – जो कोई किसी कार्य को ऐसे आशय या ज्ञान और ऐसी परिस्थितियों में करेगा कि यदि वह उस कार्य द्वारा मृत्यु कारित कर देता तो वह हत्या का दोषी होता, वह दोनों में से किसी भांति के कारावास से, जिसकी अवधि दस वर्ष तक की हो सकेगी, दंडित किया जाएगा और जुर्माने से भी दंडनीय होगा, और यदि ऐसे कार्य द्वारा किसी व्यक्ति को उपहति कारित हो जाए, तो वह अपराधी या तो आजीवन कारावास से या ऐसे दंड से दंडनीय होगा, जैसा एतस्मिनपूर्व वर्णित है।
आजीवन सिद्धदोष द्वारा प्रयत्न – जब कि इस धारा में वर्णित अपराध करने वाला कोई व्यक्ति आजीवन कारावास के दंडादेश के अधीन हो, तब यदि उपहति कारित हुई हो, तो वह मृत्यु से दंडित किया जा सकेगा।
दृष्टान्त
(क) य का वध करने के आशय से क उस पर ऐसी परिस्थितियों में गोली चलाता है कि यदि मृत्यु हो जाती तो, क हत्या का दोषी होता। क इस धारा के अधीन दंडनीय है।
(ख) क कोमल वयस के शिशु की मृत्यु करने के आशय से उसे एक निर्जन स्थान में अरक्षित छोड़ देता है। क ने उस धारा द्वारा पारिभाषित अपराध किया है, यद्यपि परिणामस्वरूप उस शिशु की मृत्यु नहीं होती।
(ग) य की हत्या का आशय रखते हुए क एक बन्दूक खरीदता है और उसको भरता है। क ने अभी तक अपराध नहीं किया है। य पर क बन्दूक चलाता है। उसने इस धारा में पारिभाषित अपराध किया है, और यदि इस प्रकार गोली मार कर वह य को घायल कर देता है, तो वह इस धारा के प्रथम पैरे के पिछले भाग द्वारा उपबंधित दंड से दंडनीय है।
(घ) विष द्वारा य की हत्या करने का आशय रखते हुए क विष खरीदता है, और उसे उस भोजन में मिला देता है, जो क के अपने पास रहता है, क ने इस धारा में पारिभाषित अपराध अभी तक नहीं किया है। क उस भोजन को य की मेज पर रखता है, या उसको य की मेज पर रखने के लिए य के सेवकों को परिदत्त करता है। क ने इस धारा में परिभाषित अपराध किया है।
According to Section 307 of the Indian Penal Code 1860,
Attempt to murder — Whoever does any act with such intention or knowledge, and under such circumstances that, it he by that act caused death, he would be guilty of murder, shall be punished with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine; and if hurt is caused to any person by such act, the offender shall be liable either to imprisonment for life, or to such punishment as is hereinbefore mentioned.
Attempts by life convicts — When any person offending under this section is under sentence of imprisonment for life, he may, if hurt is caused, be punished with death.
Illustrations
(a) A shoots at Z with intention to kill him, under such circumstances that, if death ensued. A would be guilty of murder. A is liable to punishment under this section.
(b) A, with the intention of causing the death of a child of tender years, exposes it in a desert place. A has committed the offence defined by this section, though the death of the child does not ensue.
(c) A, intending to murder Z, buys a gun and loads it. A has not yet committed the offence. A fires the gun at Z. He has committed the offence defined in this section, and, if by such firing he wounds Z, he is liable to the punishment provided by the latter part of the first paragraph of this section.
(d) A, intending to murder Z by poison, purchases poison and mixes the same with food which remains in A’s keeping; A has not yet committed the offence defined in this section. Places the food on Z’s table or delivers it to Z’s servants to place it on Z’s table. A has committed the offence defined in this section.
