भारतीय दंड संहिता 1860 की धारा 120 के अनुसार,
कारावास से दंडनीय अपराध करने की परिकल्पना को छिपाना – जो कोई उस अपराध का किया जाना, जो कारावास से दंडनीय है, सुकर बनाने के आशय से या सम्भाव्यत: तदद्वारा सुकर बनाएगा यह जानते हुए–
ऐसे अपराध के किए जाने की परिकल्पना के अस्तित्व को किसी कार्य या अवैध लोप द्वारा स्वेच्छया छिपाएगा या ऐसी परिकल्पना के बारे में ऐसा व्यपदेशन करेगा जिसका मिथ्या होना वह जानता है,
यदि अपराध कर दिया जाए – यदि अपराध नहीं किया जाए – यदि ऐसा अपराध कर दिया जाए, तो वह उस अपराध के लिए उपबन्धित भांति के कारावास से, जिसकी अवधि ऐसे कारावास की दीर्घतम अवधि की एक चौथाई तक की हो सकेगी, और यदि वह अपराध नहीं किया जाए, तो वह ऐसे कारावास से, जिसकी अ वधि ऐसे कारावास की दीर्घतम अवधि के आठवें भाग तक की हो सकेगी, या ऐसे जुर्माने से, जो उस अपराध के लिए उप बन्धित है, या दोनों से, दंडित किया जाएगा।
भारतीय दंड संहिता 1860 की धारा 120 (क) के अनुसार,
आपराधिक षड़यंत्र की परिभाषा – जबकि दो या अधिक व्यक्ति–
(1) कोई अवैध कार्य, अथवा
(2) कोई ऐसा कार्य, जो अवैध नहीं है, अवैध साधनों द्वारा, करने या करवाने को सहमत होते हैं, तब ऐसी सहमति आपराधिक षड्यंत्र कहलाती है:
परंतु किसी अपराध को करने की सहमति के सिवाय कोई सहमति आपराधिक षड़यंत्र तब तक न होगी, जब तक कि सहमति के अलावा कोई कार्य उसके अनुसरण में उस सहमति के एक या अधिक पक्षकारों द्वारा नहीं कर दिया जाता।
स्पष्टीकरण – यह तत्वहीन है कि अवैध कार्य ऐसी सहमति का चरम उद्देश्य है या उस उद्देश्य का आनुषंगिक मात्र है।
भारतीय दंड संहिता 1860 की धारा 120 (ख) के अनुसार,
आपराधिक षड़यंत्र का दंड – (1) जो कोई मृत्यु, आजीवन कारावास या दो वर्ष या उससे अधिक अवधि के कठिन कारावास से दंडनीय अपराध करने के आपराधिक षड्यंत्र में शरीक होगा, यदि ऐसे षड़यंत्र के दंड के लिए इस संहिता में कोई अभिव्यक्त उपबंध नहीं है, तो वह उसी प्रकार दंडित किया जाएगा, मानो उसने ऐसे अपराध का दुष्प्रेरण किया था।
(2) जो कोई पूर्वोक्त रूप से दंडनीय अपराध को करने के आपराधिक षड़यंत्र से भिन्न किसी आपराधिक षड़यंत्र में शरीक होगा, वह दोनों में से किसी भांति के कारावास से, जिसकी अवधि छह माह से अधिक की नहीं होगी या जुर्माने से, या दोनों से दंडित किया जाएगा।
According to Section 120 of the Indian Penal Code 1860,
Concealing design to commit offence punishable with imprisonment — Whoever, intending to facilitate or knowing it to be likely that he will thereby facilitate the commission of an offence punishable with imprisonment—
Voluntarily conceals, by any act or illegal omission, the existence of a design to commit such offence, or makes any representation which he knows to be false respecting ‘such design—
If offence be committed — if offence be not committed — shall, if the offence be committed, be punished with imprisonment of the description provided for the offence, for a term which may extend to one forth, and, if the offence be not Committed, to one-eighth, of the longest term of such imprisonment, or with such fine as is provided for that offence, or with both.
According to Section 120-A of the Indian Penal Code 1860,
Definition of criminal conspiracy — When two or more persons agree to do, or cause to be done.
(1) an illegal act, or
(2) an act which is not illegal by illegal means, such an agreement is designated a criminal conspiracy. Provided that no agreement except an agreement to commit an offence shall amount to a criminal conspiracy unless some act besides the agreement is done by one or more parties to such agreement in pursuance thereof.
Explanation — It is immaterial whether the illegal act is the ultimate object of such agreement, of is merely incidental to that object.
According to Section 120-B of the Indian Penal Code 1860,
Punishment of criminal conspiracy — (1) Whoever is a party to a criminal conspiracy to commit an offence punishable with death, imprisonment for life or rigorous imprisonment for a term of two years or upwards, shall, where no express provision is made in this Code for the punishment of such a conspiracy, be punished in the same manner as if he had abetted such offence.
(2) Whoever is a party to a criminal conspiracy other than a criminal conspiracy to commit an offence punishable as aforesaid shall be punished with imprisonment of either description for a term not exceeding six months, or with fine or with both.
