भारतीय दंड संहिता 1860 की धारा 107 के अनुसार,
किसी बात का दुष्प्रेरण – वह व्यक्ति किसी बात के किए जाने का दुष्प्रेरण करता है, जो –
पहला – उस बात को करने के लिए किसी व्यक्ति को उकसाता है; अथवा
दूसरा – उस बात को करने के लिए किसी षड्यन्त्र में एक या अधिक अन्य व्यक्ति या व्यक्तियों के साथ सम्मिलित होता है, यदि उस षड्यन्त्र के अनुसरण में, और उस बात को करने के उद्देश्य से, कोई कार्य या अवैध लोप घटित हो जाए; अथवा
तीसरा – उस बात के लिए किए जाने में किसी कार्य या अवैध लोप द्वारा साशय सहायता करता है।
स्पष्टीकरण 1 – जो कोई व्यक्ति जानबूझकर दुर्व्यपदेशन द्वारा, या तात्विक तथ्य, जिसे प्रकट करने के लिए वह आबद्ध है, जाबूझकर छिपाने द्वारा, स्वेच्छया किसी बात का किया जाना कारिता या उपाप्त करता है अथवा कारित या उपाप्त करने का प्रयत्न करता है, वह उस बात का किया जाना उकसाता है, यह कहा जाता है।

क, एक लोक आफिसर, न्यायालय के वारण्ट द्वारा य को पकड़ने के लिए प्राधिकृत है। ख उस तथ्य को जानते हुये और यह भी जानते हुए कि ग, य नहीं है, क को जानबूझकर यह व्यपदिष्ट करता है कि ग, य है, और तद्द्वारा साशय क से य को पकड़वाता है। यहां ख, ग के पकड़े जाने का उकसाने द्वारा दुष्प्रेरण करता है।
स्पष्टीकरण 2– जो कोई या तो किसी कार्य के किए जाने से पूर्व या किए जाने के समय, उस कार्य के किए जाने को सुकर बनाने के लिए कोई बात करता है और तदद्वारा उसके किए जाने को सुकर बनाता है, वह उस कार्य के करने में सहायता करता है, यह कहा जाता है।
According to Section 107 of the Indian Penal Code 1860,
Abetment of a thing — A person abets the doing of a thing, who—
Firstly — Instigates any person to do that thing; or
Secondly — Engages with one or more other person of persons in any conspiracy for the doing of that thing, if an act or illegal omission takes place in pursuance of that conspiracy, and in order to the doing of that thing; or
Thirdly — Intentionally aids, by any act or illegal omission, the doing of that thing.
Explanation 1 — A person who, by willful misrepresentation, or by willful concealment of a material fact which he is bound to disclose, voluntarily causes or procures, or attempts to cause or procure, a thing to be done, is said to instigate the doing of that thing.
Illustration
A, a public officer, is authorised by a warrant from a Court of Justice to apprehend Z. B, knowing that fact and also that C is not Z, willfully represents to A that C is Z, and thereby intentionally causes A to apprehend C. Here B abets by instigation the apprehension of C.
Explanation 2 — Whoever, either prior to or at the time of the commission of an act, does anything in order to facilitate the commission of that act, and thereby facilitates the commission thereof, is said to aid the doing of that Act.
