भारतीय दंड संहिता 1860 की धारा 498 क के अनुसार,
किसी स्त्री के पति या पति के नातेदार द्वारा उसके प्रति क्रूरता करना – जो कोई, किसी स्त्री का पति या पति नातेदार होते हुए, ऐसी स्त्री के प्रति क्रूरता करेगा, वह कारावास से, जिसकी अवधि तीन वर्ष तक की हो सकेगी, दंडित किया जायेगा और जुर्माने से भी दंडनीय होगा।
स्पष्टीकरण – इस धारा के प्रयोजनों के लिए ‘क्रूरता’ से निम्नलिखित अभिप्रेत है:
(क) जानबूझकर किया गया कोई आचरण जो ऐसी प्रकृति का है जिससे उस स्त्री को आत्महत्या करने के लिये प्रेरित करने की या उस स्त्री के जीवन, अंग या स्वास्थ्य को (जो चाहे मानसिक हो या शारीरिक) गम्भीर क्षति या खतरा कारित करने की संभावना है; या
(ख) किसी स्त्री को तंग करना, जहां उसे या उससे संबंधित किसी व्यक्ति को किसी सम्पत्ति या मूल्यवान प्रतिभूति के लिए किसी विधिविरुद्ध मांग को पूरी करने के लिए प्रपीड़ित करने की दृष्टि से या उसके अथवा उससे संबंधित किसी व्यक्ति के ऐसे मांग पूरी करने में असफल रहने के कारण इस प्रकार तंग किया जा रहा है।
According to Section 498-A of the Indian Penal Code 1860,
Husband or relative of husband of a woman subjecting her to cruelty — Whoever, being the husband or the relative of the husband woman, subjects such woman to cruelty, shall be punished with imprisonment a term which may extend to three years, and shall also be liable to fine.
Explanation — For the purpose of this section, ‘cruelty’ means—
(a) any willful conduct which is of such a nature as is likely to drive the woman to commit suicide or to cause grave injury or danger to life, limb or health (whether mental or physical) of the woman; or
(b) harassment of the woman where such harassment is with a view to coercing her or any person related to her to meet any unlawful demand for any property or valuable security or is on account of failure by her or any person related to her to meet such demand.
